{"id":34,"date":"2021-03-25T20:27:58","date_gmt":"2021-03-26T00:27:58","guid":{"rendered":"http:\/\/dougsdepot.com\/news-updates\/?p=34"},"modified":"2021-03-25T20:54:11","modified_gmt":"2021-03-26T00:54:11","slug":"us-appeals-court-rules-americans-dont-have-right-to-open-carry-guns-in-public","status":"publish","type":"post","link":"https:\/\/dougsdepot.com\/news-updates\/us-appeals-court-rules-americans-dont-have-right-to-open-carry-guns-in-public\/","title":{"rendered":"US Appeals court rules Americans don\u2019t have right to open carry guns in public"},"content":{"rendered":"<div id=\"modal-ready\">\n<figure class=\"wp-block-image size-large\"><img decoding=\"async\" src=\"https:\/\/dougsdepot.com\/news-updates\/wp-content\/uploads\/2021\/03\/Screenshot_2021-03-25-US-Appeals-court-rules-Americans-dont-have-right-to-open-carry-guns-in-public.png\" alt=\"\" class=\"wp-image-37\"\/><\/figure>\n\n\n\n<p>On Wednesday, an en banc panel of the US Court of Appeals for the 9th Circuit ruled that the second amendment right to keep and bear arms does not citizens include the right to carry a firearm, either openly or concealed, in public .<\/p>\n\n\n\n<p>The court issued the ruling in the case of <em>George Young Jr. V Hawaii<\/em>, a lawsuit challenging a Hawaii firearm licensing law, which states residents seeking license to openly carry a firearm in public must demonstrate \u201cthe urgency or the need\u201d to carry a firearm, must be of good moral character, and must be \u201cengaged in the protection of life and property.\u201d The court said, \u201cThere is no right to carry arms openly in public; nor is any such right within the scope of the Second Amendment.\u201d<\/p>\n\n\n\n<p>The majority ruled opinion covers Hawaii\u2019s law regarding open carrying a firearm and the court further states, \u201cWe have previously held that individuals do not have a Second Amendment right to carry concealed weapons in public\u201d meaning they believe no right to carry a firearm in any capacity in public exists.<\/p>\n\n\n\n<p>Four judges dissented from the majority decision in two different dissenting opinions. In one of the dissenting opinions, three judges argued, \u201cThe majority\u2019s suggestion that the values of federalism somehow preclude the Second Amendment from guaranteeing an individual right to carry arms for self-defense in the public square is fundamentally misguided\u201d adding, \u201cHawaii\u2019s severe deprivation of the core right to carry a firearm in public can only be understood as amounting to a total destruction of such right.\u201d<\/p>\n\n\n\n<p>Responding to the decision, the National Rifle Association tweeted, \u201cBREAKING: The US Court of Appeals for the 9th Circuit just ruled that THERE IS NO RIGHT TO CARRY \u2013 either openly or concealed in public. This ruling impacts RTC laws in AK, HI, CA, AZ, OR, WA, &amp; MT. This was not an NRA case but we are exploring all options to rectify this.\u201d<\/p>\n\n\n\n<figure class=\"wp-block-image size-large is-resized\"><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/dougsdepot.com\/news-updates\/wp-content\/uploads\/2021\/03\/twitter.png\" alt=\"\" class=\"wp-image-35\" width=\"837\" height=\"620\" srcset=\"https:\/\/dougsdepot.com\/news-updates\/wp-content\/uploads\/2021\/03\/twitter.png 500w, https:\/\/dougsdepot.com\/news-updates\/wp-content\/uploads\/2021\/03\/twitter-300x222.png 300w\" sizes=\"auto, (max-width: 837px) 100vw, 837px\" \/><\/figure>\n\n\n\n<p>The appeals court\u2019s en banc decision could be appealed to the U.S. Supreme Court, though the Supreme Court has not heard a second amendment case in more than ten years. In April of 2020, the Supreme Court <a href=\"https:\/\/americanmilitarynews.com\/2020\/04\/supreme-court-throws-out-ny-gun-case-first-second-amendment-case-in-10-years\/\" target=\"_blank\" rel=\"noreferrer noopener\">declined to hear a case<\/a> of <em>New York State Rifle &amp; Pistol Association v. City of New York, New York<\/em>, which raised issue with a now rescinded New York City rule that prohibited residents from transporting firearms to shooting ranges, competitions and even their secondary residences outside of the city.<\/p>\n\n\n\n<p>Representing the plaintiffs Former Bush administration Solicitor General Paul Clement urged the Supreme Court to take up the case, saying the \u201csingle most important unresolved Second Amendment question\u201d on whether the right to bear arms for self-defense extends to \u201cwhere confrontations often occur: outside the home.\u201d<\/p>\n\n\n\n<p>New York Attorney General Letitia James has written that New York\u2019s laws limiting public carry of firearms is \u201cconsistent with the historical scope of the Second Amendment and directly advances New York\u2019s compelling interests in public safety and crime prevention.\u201d<\/p>\n\n\n\n<p>Some gun rights activists have looked to Justice Amy Coney Barrett\u2019s appointment to the Supreme Court as a development that could once again bring second amendment cases back to the highest court in the U.S. In an October <a rel=\"noreferrer noopener\" href=\"https:\/\/www.cnn.com\/2021\/03\/23\/politics\/scotus-second-amendment-new-york-boulder-colorado\/index.html\" target=\"_blank\">interview with<\/a> CNN, Jacob D.
