(WKBW) — Smoking recreational marijuana is now legal in New York State, but that doesn&#8217;t mean gun laws associated with marijuana have changed.</p><p>According to Legal Expert Florina Altshiler, the Gun Control Act of 1968 prohibits the ownership of guns for anyone who is in possession of marijuana. That means, there must be a choice between being a gun owner or a marijuana smoker.</p><p>&#8220;Anyone who uses marijuana is going to qualify as an unlawful user of an abused substance even though it is technically lawful,&#8221; Altshiler said.</p><p>Background checks will still be required to purchase a gun. It is then that a person would have to notify the ATF of marijuana smoking. According to Altshiler, that is the only real way that this will be enforced.</p><p>&#8220;Of course if you&#8217;re not convicted of a crime related to marijuana or have a medical card, there&#8217;s really no way of knowing if someone is or isn&#8217;t a marijuana user,&#8221; Altshiler said.</p><p>With the federal Gun Control Act of 1968 superseding the state legalization of recreational marijuana, an arrest would only be for illegal possession of a firearm, not for marijuana.</p><p>&#8220;There is no charge for marijuana possession,&#8221; Altshiler said, &#8220;of course, depending on quantity.&#8221;</p><p>This is currently in effect and will also pertain to those who work in the marijuana industry.</p></div>						</div>

								<p>Monday, April 5, 2021</p><p>There is a central hypocrisy at the heart of the gun control effort. High-profile gun control-supporting politicians, the Hollywood elite, and billionaire tycoons, will advocate to strip ordinary Americans of their right to defend themselves and their family, all the while enjoying the security that armed men with guns provide. As Hunter Biden’s 2018 firearm incident shows, this hypocrisy extends even to incidents where a high-profile individual has taken the step of procuring their own firearm. The message from these elites could not be clearer: Gun laws are only for the little people.</p><p>For those who have yet to learn of Hunter’s escapades in firearm ownership, according to a report from <a href="https://www.politico.com/news/2021/03/25/sources-secret-service-inserted-itself-into-case-of-hunter-bidens-gun-477879">Politico</a>, the troubled son of the president purchased a .38-caliber revolver from a Delaware Federal Firearms Licensee (FFL) on October 12, 2018. In order to acquire the gun, Hunter filled out the required BATFE Form 4473. On October 23, Hallie Biden, widow to Joe Biden’s son Beau and then-companion to Hunter, searched the ne’er-do-well’s truck, which was parked at her home in Wilmington, Del., and found the handgun. Apparently fearing for Hunter’s safety, Hallie wrapped the revolver in a shopping bag and threw it into a trash receptacle outside nearby gourmet grocery store Janssen’s Market – which is located across the street from the campus of Alexis I. du Pont High School.</p><p>Later that day, after Hunter told Hallie to retrieve the firearm, Hallie returned to where she had disposed of the gun but could not find it. At this point law enforcement was notified of the missing firearm, prompting an investigation that reportedly involved the Delaware State Police, the United States Secret Service, and the Federal Bureau of Investigation.</p><p>As it happens, between Hallie’s disposal of the firearm and her return to the market, a man who routinely searches the store’s trash receptacles for recyclables recovered the firearm. This man returned the revolver a few days after finding it.</p><p>According to Politico, prior to the firearm’s return a pair of Secret Service agents visited the FFL where Hunter purchased the firearm in an attempt to obtain the corresponding Form 4473.</p><p>The Politico report noted,</p><p><em>Secret Service agents approached the owner of the store where Hunter bought the gun and asked to take the paperwork involving the sale, according to two people, one of whom has firsthand knowledge of the episode and the other was briefed by a Secret Service agent after the fact.</em></p><p><em>The gun store owner refused to supply the paperwork, suspecting that the Secret Service officers wanted to hide Hunter’s ownership of the missing gun in case it were to be involved in a crime, the two people said. The owner, Ron Palmieri, later turned over the papers to the Bureau of Alcohol, Tobacco, Firearms, and Explosives, which oversees federal gun laws.</em></p><p>As <a href="https://www.nraila.org/articles/20210329/hunter-biden-s-involvement-in-firearm-incident-raises-important-legal-questions">has been made clear in a previous item regarding this incident</a>, NRA does not allege that Hunter or Hallie engaged in any criminal conduct. However, Hunter and Hallie’s conduct give rise to several legal questions.</p><p>Hunter was <a href="https://www.wsj.com/articles/bidens-son-hunter-discharged-from-navy-reserve-after-failing-cocaine-test-1413499657">discharged</a> from the U.S. Navy Reserve in 2014 after he tested positive for cocaine. Further, at various times, Hunter has been a notorious and admitted drug user. Hunter’s lengthy battle with drugs has been chronicled by himself and the Biden family in numerous <a href="https://abcnews.go.com/Politics/hunter-biden-tackles-cocaine-diamonds-alleged-business-conflicts/story?id=64064060">interviews</a> and a forthcoming memoir titled, “<a href="https://www.amazon.com/Untitled-Nonfiction-AB-Confirmed-Gallery/dp/1982151110">Beautiful Things</a>.”</p><p> An April 1, 2020 <a href="https://www.usatoday.com/story/entertainment/books/2021/03/31/hunter-biden-memoir-he-opens-up-hallie-biden-crack-addiction/4826035001/">USA Today</a> piece on Hunter’s memoir contained the following summary of some of its contents,</p><p><em>In the spring of 2018, he used his &#8220;superpower – finding crack anytime, anywhere&#8221; – in Los Angeles. At one point, a dealer pointed a gun at his head before he realized Biden was looking for drugs.</em></p><p><em>He later learned how to cook drugs and spent a lot of time with thieves, addicts and con artists. &#8220;I never slept. There was no clock. Day bled into night and night into day,&#8221; he writes.</em></p><p><em>The situation grew out of control. &#8220;I was smoking crack every 15 minutes,&#8221; he writes.</em></p><p><em>Biden returned to the East Coast in the fall of 2018, again wanting to get better, though that didn&#8217;t happen.</em></p><p><em>Eventually, his family tried to stage an intervention. &#8220;I don&#8217;t know what else to do,&#8221; Joe Biden told him. &#8220;I&#8217;m so scared. Tell me what to do.&#8221; His son replied: &#8220;Not (expletive) this.&#8221;</em><em> </em></p><p><em>It wasn&#8217;t until he met now-wife Melissa Cohen in Los Angeles – whom he married after only a week of knowing – that he got sober again. They told each other they loved each other on their first date; she had the same eyes as Beau, he writes. She championed his sobriety and dumped out his crack.</em></p><p>It is illegal for a person “who is an unlawful user of or addicted to any controlled substance” to possess a firearm. Possession of a firearm by a prohibited person is punishable by up to 10 years imprisonment.</p><p>In order to purchase a firearm from an FFL, a buyer must fill out a Form 4473. The form asks, “Are you an unlawful user of, or addicted to, marijuana or any depressant, stimulant, narcotic drug, or any other controlled substance?” Hunter answered “no” to this question.</p><p>Lying on a form 4473 is two separate crimes. It is a crime when a person “knowingly makes any false statement or representation with respect to the information required by this chapter to be kept in the records of a person licensed under this chapter,” such as the Form 4473. A violation of this provision is punishable by up to 5 years imprisonment. It is also a crime for a person to “make any false or fictitious oral or written statement” to a dealer “with respect to any fact material to the lawfulness of the sale.” A violation of this provision is punishable by up to 10 years imprisonment.</p><p>Janssen’s Market is located less than 250 yards from the campus of Alexis I. du Pont High School.</p><p>As a U.S. senator, Joe Biden was a <a href="https://www.edweek.org/policy-politics/joe-biden-gun-free-school-zones-champion-busing-critic-is-running-for-president/2019/04">key proponent</a> of the federal Gun-Free School Zones Act of 1990. The initial version of this unconstitutional and unwise policy was struck down by the U.S. Supreme Court in <a href="https://supreme.justia.com/cases/federal/us/514/549/#tab-opinion-1959689"><em>U.S. v. Lopez</em></a>. A later, similarly constitutionally dubious, version remains on the books.</p><p>18 USC 922(q)(2)(A) provides,</p><p> </p><p><em>(A) It shall be unlawful for any individual knowingly to possess a firearm that has moved in or that otherwise affects interstate or foreign commerce at a place that the individual knows, or has reasonable cause to believe, is a school zone.</em></p><p>18 USC 921 (a)(25) defines school zone as, </p><p>            <em>(25) The term “school zone” means—</em></p><p><em>(A) in, or on the grounds of, a public, parochial or private school; or</em></p><p><em>(B) within a distance of 1,000 feet from the grounds of a public, parochial or private school.</em> </p><p>18 USC 922(q)(2)(B) does provide for some exemption for possession of a firearm, </p><p>            <em>(i) on private property not part of school grounds;</em></p><p><em>(ii) if the individual possessing the firearm is licensed to do so by the State in which the school zone is located or a political subdivision of the State, and the law of the State or political subdivision requires that, before an individual obtains such a license, the law enforcement authorities of the State or political subdivision verify that the individual is qualified under law to receive the license;</em></p><p><em>(iii) that is—</em></p><p><em>(I) not loaded; and</em></p><p><em>(II) in a locked container, or a locked firearms rack that is on a motor vehicle;</em></p><p><em>(iv) by an individual for use in a program approved by a school in the school zone;</em></p><p><em>(v) by an individual in accordance with a contract entered into between a school in the school zone and the individual or an employer of the individual;</em></p><p><em>(vi) by a law enforcement officer acting in his or her official capacity; or</em></p><p><em>(vii) that is unloaded and is possessed by an individual while traversing school premises for the purpose of gaining access to public or private lands open to hunting, if the entry on school premises is authorized by school authorities.</em> </p><p>Maybe Hallie had a Delaware License to Carry a Concealed Deadly Weapon or placed the firearm in a locked container while she brought the gun to the store. However, a reasonable person might wonder whether an individual who would throw a handgun wrapped in a shopping bag away in a publicly accessible trash receptacle, would comport their conduct within these narrow exceptions while traversing the public roadways to Janssen’s Market. </p><p>If Hunter and Hallie are guilty of any illegal conduct, it’s difficult to fault the pair for ignoring the potential legal ramifications of their actions. After all, these gun control measures were not designed to be followed by well-connected elites like them. </p><p>This point is underscored by the Secret Service’s alleged involvement in the case. Rather than having their conduct scrutinized by federal law enforcement, if the Politico report and <a href="https://nypost.com/2021/03/26/hunter-biden-texts-shoot-down-secret-service-denial-over-gun-incident/">Hunter’s contemporaneous text messages</a> are to be believed, the federal government tried to cover up for the prominent pair.</p><p>As well-protected politicians and their establishment allies push for new gun controls, ordinary law-abiding Americans should know that these hypocrites have no intention of parting with their own elaborate security measures or being otherwise inconvenienced by the burdens they foist upon the rest of us.</p>						</div>

It broke the record set in January of 4,317,804.</em></p><p><em>Gun sales generally track with the NICS numbers, though the FBI doesn’t make public how many were for gun purchases. Gun industry groups typically release those numbers after the FBI.</em></p><p><em>However, the numbers show that sales also likely hit a record high, a trend confirmed by sellers.</em></p><p>But this gets better — or worse, depending on your Second Amendment perspective.</p><p>Firearms groups note that Biden’s threat to use executive authority (if he, in fact, actually has the power to do so) to expand background checks and even ban the sale of semi-auto rifles like popular AR-15 models are what is driving the new sales (and take note, many gun calibers were already in short supply).</p><p>Here’s the irony: Gun sellers say that many buyers are using their $1,400 COVID stimulus checks to buy new firearms, and in particular, <em>AR-15s.</em></p><p>Like we said, the ultimate irony.</p><p>“Our sales are already well ahead of last March,” said Justin Anderson, the marketing director of Charlotte, North Carolina’s <a href="https://www.hyattgunstore.com/retail/we-buy-sell-and-trade/?utm_source=Email_marketing&amp;utm_campaign=Wednesday_March_2_2016&amp;cmp=1&amp;utm_medium=HTMLEmail" target="_blank" rel="noopener">Hyatt Guns,</a> who frequently updates Bedard regarding gun sales and gun trends.</p><p>“There are obvious factors at play here: Biden’s gun rhetoric being No. 1, as well as two mass shootings that were heavily covered in the media. However, we also saw a lot of transactions of around $1,400 starting on March 17, so it appears many people are using their stimulus money to buy guns,” Anderson added.</p><p>He then said: “I think it’s ironic that a Democrat Party-led Congress and a Democrat president passed legislation to give people financial relief, and a significant amount is being spent on gun purchases, many of which are for AR-15s!”</p><p>Yep. So do we.</p><p>As for gun sales, they have been setting records for the past year as Democrat-run cities devolved into chaos and mayhem, with looting and riots that quickly escalated well beyond the George Floyd incident that was exploited by Black Lives Matter and Antifa, both groups of which also pushed a “Defund the Police” initiative that actually took hold in some cities.</p><p>As for Biden’s executive actions on guns, it’s not at all clear that they’ll pass constitutional muster and are likely going to be challenged in court no sooner than they drop. He no doubt knows this so maybe he’s just going to issue them and see where the legal chips fall.</p><p>Meantime, many Americans appear to be making good use of their COVID relief money.</p><p> </p><p> </p>						</div>

								<address data-n="">by:    <a title="Posts by AWR Hawkins" href="https://www.breitbart.com/author/awr-hawkins/">AWR Hawkins  </a><time datetime="2021-04-05T09:07:07Z">5 Apr 2021</time></address><p>The Guardian <a class="x5l" href="https://www.theguardian.com/us-news/2021/apr/05/us-gun-ownership-black-americans-surge" target="_blank" rel="noopener external">reports</a>, “gun ownership among Black Americans is up 58.2 percent.”</p><p>The paper cites National Shooting Sports Foundation (NSSF) figures showing “Americans bought a record number of firearms last year,” including an “estimated 5 million people [who] bought their first ever gun between March and August.”</p><p>Black Americans witnessed the greatest increase among all first-time gun buyers.</p><p>Gun rights groups like the National African American Gun Association have subsequently seen giant leaps in membership.</p><p>Anubis Heru owns the <a class="x5l" href="https://1770armory.com/" target="_blank" rel="noopener external">1770 Armory and Gun Club</a> in Denver, the first firearm store and simulator range in Colorado to be owned by a black American.</p><p>Heru commented on the existence of gun rights groups focused on black Americans, “The value of these groups is learning with people who know your struggle and understand what’s happening and has been happening with this country. Black people and women of color like to come to our facility because we’re not the typical redneck with a tattoo of the Three Percenters.”</p><p>On March 2, 2o21, Breitbart News <a href="https://www.breitbart.com/politics/2021/03/02/chicago-tribune-blacks-flood-concealed-carry-courses-seeking-safety/">reported</a> black Chicagoans were flooding into concealed carry courses seeking to defend themselves against the crime in the Windy City.</p><p>The <em>Chicago Tribune</em> <a class="x5l" href="https://www.chicagotribune.com/news/breaking/ct-black-gun-ownership-increasing-20210301-y3pdyrzspjdlhbm4ksre2amcfi-story.html" target="_blank" rel="noopener external">reports</a> that when one considers new customers nationally in the gun community in 2020, “black customers accounted for the largest increase of any racial group.” In Chicago specifically, black residents are pouring into gun courses and concealed carry courses, seeking a way to protect themselves from the violence that is all around.</p><p><em>AWR Hawkins is an award-winning Second Amendment columnist for Breitbart News and the writer/curator of <a href="https://www.breitbart.com/downrange/" target="_blank" rel="noopener">Down Range with AWR Hawkins</a>, a weekly newsletter focused on all things Second Amendment, also for Breitbart News. 								<p class="entry-meta"><time class="entry-time">April 2, 2021</time> By <span class="entry-author"><a class="entry-author-link" href="https://www.libertyparkpress.com/author/dave/" rel="author"><span class="entry-author-name">Dave Workman</span></a></span></p><p>Fox News <a href="https://www.foxnews.com/politics/22-states-ninth-circuit-californias-large-capacity-magazine-ban">is reporting</a> that the attorneys general in 22 states have signed onto an amicus brief to the Ninth U.S. Circuit Court of Appeals, urging the court to “<a href="https://www.foxnews.com/politics/california-ninth-circuit-high-capacity-magazine-ban">again rule against</a> California’s controversial attempt to ban high-capacity magazines, after the court agreed to reconsider its decision to rule it unconstitutional.”</p><p>The case is <a href="https://cdn.ca9.uscourts.gov/datastore/opinions/2020/08/14/19-55376.pdf"><em>Duncan v. Becerra</em></a>, and it may provide an avenue to a Supreme Court consideration about a restrictive gun control law that has affected millions of gun owners in several states.</p><p>Initially, District Court Judge Roger Benitez in San Diego ruled the California ban on so-called “high capacity magazines” was unconstitutional under the Second Amendment. The case was appealed to the Ninth Circuit, and last year, a three-judge panel ruled 2-1 to uphold Benitez.</p><p>Then the court decided to re-hear the case with an <em>en banc</em> 11-judge panel. It has become a closely-watched case that—depending upon the outcome—could throw gun control into chaos, and not just in California.</p><p>Signing onto the <a href="https://www.scribd.com/document/501286226/Amicus-Brief-in-Duncan-v-Becerra#from_embed">23-page brief </a>are Republican attorneys general representing Alabama, Alaska, Arizona, Arkansas, Georgia, Idaho, Indiana, Kansas, Kentucky, Louisiana, Mississippi, Missouri, Montana, Nebraska, Ohio, Oklahoma, South Carolina, South Dakota, Texas, Utah, West Virginia, and Wyoming, according to the brief.</p><p>In their brief, led by Arizona Attorney General Mark Brnovich and Louisiana Attorney General Jeff Landry, they write, “Calling the Affected Magazines “large-capacity” is a misnomer—they often hold only in the range of eleven to fifteen rounds (in no way a large absolute number) and come standard with many of the most popular firearms. There is nothing sinister about citizens bearing the Affected Magazines.”</p><p>That’s not how anti-gunners see it. In their opinion, such magazines contribute to higher body counts during mass shootings.</p><p>A few lines later, the brief observes, “The Amici States join together on this brief not merely because they disagree with California’s policy choice, but because the challenged law represents a policy choice that is foreclosed by the Second Amendment. States may enact reasonable firearm regulations that do not categorically ban common arms core to the Second Amendment, but the challenged law fails as it is prohibitive rather than regulatory. California should not be allowed to invade its own citizens’ constitutional rights, and this Court should not imperil the rights of citizens in this Circuit and other states with its analysis.”</p><p>Magazines holding 20 or 30 rounds are common for AR15-type rifles. The AR15 is frequently called the most popular rifle in America today, with millions of them in private ownership for hunting, competition, home defense, predator control and other legitimate uses. While they have been used in mass shootings, rifles of any kind are used in a fraction of all homicides during any given year, according to data from the FBI annual Uniform Crime Report.</p>						</div>

(WSET) — </span>Lawmakers on Capitol Hill are at odds over new gun laws headed to the Senate.</p><p>The House approved new bills aimed at restricting how you buy a gun in light of recent mass shootings.</p><p><a class="themeColorForLinks" title="Enhanced Background Checks Act of 2021" href="https://wset.com/news/local/Enhanced Background Checks Act of 2021" target="_blank" rel="noopener">HR8</a> and the <a class="themeColorForLinks" title="https://www.congress.gov/bill/117th-congress/house-bill/1446" href="https://www.congress.gov/bill/117th-congress/house-bill/1446" target="_blank" rel="noopener">Enhanced Background Checks Act of 2021</a> are the names of the two bills.</p><p>Here&#8217;s what those would change:</p><ul><li>Background checks would be expanded.</li><li>Private sales between unlicensed people would now require one.</li><li>Also, it would prevent sales before a background check is finished.</li></ul><p>Currently, under federal law, the FBI has three days to investigate. Will we see another one soon?</a></strong></p><p>Some of the ideas, like generalized background checks, are bipartisan. Others are more divisive.</p><p>&#8220;We have got to enforce the gun laws that we have now, which are to restrict those that have broken the law from being able to get a firearm,&#8221; says Congressman Bob Good. &#8220;I support that.&#8221;</p><p>It&#8217;s still up in the air whether these bills will pass through the Senate.</p><p>Congressman Good says he hopes the Senate will relax the limitations on gun sales between family members outlined in the House-approved bills.</p><p>Sen. Tim Kaine will soon vote on these bills.</p><p>&#8220;I think these will take meaningful steps on background checks and other steps that will provide greater protection to people from gun violence,&#8221; says Sen. Kaine. </p><p>Sen. Kaine says his goal once the Senate is back in session is to work towards solutions that end gun violence.</p><p>It will be a few weeks before these bills are brought to the Senate floor. Then, the Senate will have the opportunity to amend these bills before voting.</p><p>If passed, President Biden can sign them into law.</p>						</div>

That&#8217;s because, under current law, Iowans must pass a background check to obtain a permit to carry or acquire a handgun before they can legally buy one in a private sale.</p><p class="gnt_ar_b_p">On a recent call with Everytown for Gun Safety, Democrats, including Senate Minority Leader Zach Wahls, D-Coralville, called on Reynolds to veto the legislation.</p><p class="gnt_ar_b_p">&#8220;A person could be able to purchase a firearm from a private seller with no background check and then carry that firearm anywhere in public without any type of firearms proficiency training if this bill is adopted,&#8221; Wahls said on the call, explaining why he thought Reynolds should veto the measure.</p><p class="gnt_ar_b_p">Wahls also pointed to Reynolds&#8217; own prior comments in support of Iowa&#8217;s current gun laws.</p><p class="gnt_ar_b_p">In 2018 and 2019 Reynolds said Iowa had “reasonable and responsible gun laws on the books” and that she believed the current permit system — which she voted for as a state senator in 2010 — should remain in place.</p><p class="gnt_ar_b_p"><strong class="gnt_ar_b_al">More:</strong><a class="gnt_ar_b_a" href="https://www.desmoinesregister.com/story/news/politics/2021/03/22/iowa-gun-bill-senate-handgun-permit-requirements-sent-governor-kim-reynolds-concealed-carry/4799257001/" target="_blank" rel="noopener" data-t-l="|inline|intext|n/a">Iowa close to allowing no-permit handgun buying, carry. How would the gun law work?</a></p><p class="gnt_ar_b_p">At a news conference last week, Reynolds <a class="gnt_ar_b_a" href="https://www.desmoinesregister.com/story/news/politics/2021/03/24/kim-reynolds-says-shes-reviewing-iowa-bill-2021-allowing-handguns-to-be-carried-purchased-no-permit/6985463002/" target="_blank" rel="noopener" data-t-l="|inline|intext|n/a">said she would &#8220;do a thorough evaluation&#8221;</a> of the legislation before deciding whether to sign it. She said that approach was consistent with her previous comments.</p><p class="gnt_ar_b_p">&#8220;I said I thought the policies were good that were in place but I will continue to take a look at new legislation that is presented,&#8221; she said. &#8220;And I think that’s the appropriate approach, and that’s what we’re doing right now. And I’ve been very consistent in my messaging on that.&#8221;</p><p class="gnt_ar_b_p">The bill signing comes weeks after two high-profile mass shootings in Atlanta, Georgia, and Boulder, Colorado, <a class="gnt_ar_b_a" href="https://www.desmoinesregister.com/story/news/nation/2021/04/01/mass-shootings-georgia-colorado-expose-lax-gun-laws-amid-cries-reform/7061512002/" target="_blank" rel="noopener" data-t-l="|inline|intext|n/a">drew renewed attention to gun laws</a>.</p><p class="gnt_ar_b_p">&#8220;We must do more than just pray for those victims and their families, and we must do more to honor their memories than just fly the flags at half-staff,&#8221; Wahls said on the call urging Reynolds to veto the legislation. &#8220;We have to do everything that we can to prevent this senseless violence in the future.&#8221;</p><p class="gnt_ar_b_p"><strong class="gnt_ar_b_al">More:</strong><a class="gnt_ar_b_a" href="https://www.desmoinesregister.com/story/news/nation/2021/04/01/mass-shootings-georgia-colorado-expose-lax-gun-laws-amid-cries-reform/7061512002/" target="_blank" rel="noopener" data-t-l="|inline|intext|n/a">&#8216;Why does this keep happening?&#8217; Mass shootings in Boulder and Atlanta expose loopholes, weaknesses in gun laws</a></p><h2 class="gnt_ar_b_h2">More information to be shared on people barred from having guns</h2><p class="gnt_ar_b_p">The law requires courts to report to a state law enforcement database when someone is determined to be ineligible to possess a firearm for mental health reasons, in addition to reporting that to the federal background check system. And it expands what Iowa reports to the federal background check system about people who are ineligible to possess firearms under state law.</p><p class="gnt_ar_b_p">Reynolds praised those provisions in her statement, saying the law &#8220;takes greater steps to inform law enforcement about an individual&#8217;s mental illness, helping ensure firearms don&#8217;t end up in the wrong hands.&#8221;</p><p class="gnt_ar_b_p">&#8220;We will never be able to outlaw or prevent every single bad actor from getting a gun, but what we can do is ensure law-abiding citizens have full access to their constitutional rights while keeping Iowans safe,&#8221; she said in the statement.</p><h2 class="gnt_ar_b_h2">Gun control groups: &#8216;We will not forget that in 2022&#8217;</h2><p class="gnt_ar_b_p">Reaction to the law came swiftly, with pro-gun groups like the National Rifle Association <a class="gnt_ar_b_a" href="https://twitter.com/NRA/status/1378068184331354115?s=20" target="_blank" rel="noopener" data-t-l="|inline|intext|n/a">applauding Reynolds</a> and opponents promising to make the law a liability for Reynolds when she faces reelection next year.</p><p class="gnt_ar_b_p">Chloe Gayer, a volunteer with Iowa Students Demand Action, a gun violence prevention group that is part of Everytown for Gun Safety, said there&#8217;s no reason Reynolds should have signed the law.</p><p class="gnt_ar_b_p">&#8220;We know — and polling proves — that the vast majority of Iowans, including gun owners, support background checks and requiring a permit to carry a concealed gun,&#8221; she said in a statement. &#8220;This common-sense law made us safer and now Gov. Reynolds has made Iowa a more dangerous place — we will not forget that in 2022.&#8221;</p><p class="gnt_ar_b_p">Republican Party of Iowa Chair Jeff Kaufmann <a class="gnt_ar_b_a" href="https://twitter.com/kaufmannGOP/status/1378069984199516160?s=20" target="_blank" rel="noopener" data-t-l="|inline|intext|n/a">said on Twitter </a>that &#8220;despite the misinformation pushed by Democrats and coastal interest groups&#8221; the law makes it more difficult for criminals to buy firearms and protects the rights of law-abiding citizens.</p><p class="gnt_ar_b_p">&#8220;There is only one party committed to protecting the rights and freedoms of Iowans and that&#8217;s the Republican Party,&#8221; Kaufmann said.</p><h2 class="gnt_ar_b_h2">Iowa joins other permitless carry states</h2><p class="gnt_ar_b_p">Tennessee is also <a class="gnt_ar_b_a" href="https://www.desmoinesregister.com/story/news/politics/2021/04/01/new-no-permit-tennessee-handgun-carry-bill-what-to-know/4836900001/" target="_blank" rel="noopener" data-t-l="|inline|intext|n/a">poised to allow adults 21 and older to carry handguns without obtaining a permit</a>. The Tennessee House of Representatives passed the bill on Monday and Gov. Bill Lee is expected to sign it.</p><p class="gnt_ar_b_p">In addition to Iowa and Tennessee, at least 15 states already allow concealed carry of handguns without a permit, according to the U.S. Concealed Carry Association and Everytown for Gun Safety. Two of those, North Dakota and Wyoming, allow permitless carry only for their own residents.</p><p class="gnt_ar_b_p">In 2020, Iowa law enforcement issued 85,986 nonprofessional permits to carry weapons and 14,960 permits to acquire pistols and revolvers, according to data provided by the Iowa Department of Public Safety. Those numbers were higher than in the previous three years.</p><p class="gnt_ar_b_p">In 2021, as of March 23, law enforcement had already issued 41,568 permits to carry and 2,638 permits to acquire.</p><p class="gnt_ar_b_p">In 2020, there were 270,614 background checks conducted in Iowa through the National Instant Criminal Background Check System, which is operated by the FBI. If they choose not to get a permit, they must pass a background check when buying a gun from a federally licensed dealer.</p><p class="gnt_ar_b_p">Supporters say many Iowans will still apply for permits so they can carry their weapons out of state. In all, 36 states and territories, including Iowa, either recognize Iowa&#8217;s permits or do not require permits to carry firearms.</p><p class="gnt_ar_b_p">Iowans would no longer have to obtain a permit before acquiring a handgun through sales between private citizens.</p><p class="gnt_ar_b_p">Currently, there are no background checks for private handgun sales under Iowa or federal law, but opponents of the law say the permitting process ensures people purchasing handguns in private sales have undergone a background check in the past.</p><p class="gnt_ar_b_p">It would become a Class D felony to sell, rent or loan a gun to a person that the seller &#8220;knows or reasonably should know&#8221; is prohibited from owning firearms. That crime would be punishable by up to five years in prison. </p><p class="gnt_ar_b_p">Republicans have said the increased penalty will be a deterrent to illegal or questionable sales. Democrats say it will be difficult to prosecute anyone unless there was clear proof the seller knew they were selling a handgun to someone who was legally barred from owning one.</p><p class="gnt_ar_b_p">Reynolds on Friday also signed <a class="gnt_ar_b_a" href="https://www.legis.iowa.gov/legislation/BillBook?ga=89&amp;ba=HF%20621" target="_blank" rel="noopener" data-t-l="|inline|intext|n/a">a law</a> limiting the types of lawsuits that can be filed against gun and ammunition manufacturers. When it takes effect July 1, that law will prevent people from filing lawsuits related to the lawful design, manufacture, marketing or sale of firearms and firearms accessories. The lawmakers also banned large magazine clips that have been frequently used in mass shootings.</p><p><a href="https://legis.delaware.gov/json/BillDetail/GenerateHtmlDocument?legislationId=58548&amp;legislationTypeId=6&amp;docTypeId=2&amp;legislationName=SS1">Senate Bill 3</a> would require anyone who wants to buy a handgun to first undergo a training course and apply for a permit. Currently, only those who carry concealed weapons in Delaware are required to get training and a permit.</p><p>“It ensures that handgun owners will have undergone firearm training courses to reduce the number of accidental shootings, suicides, and gun deaths,” said the bill’s prime sponsor, Sen. Tizzy Lockman. “That will keep everyone that much safer.”</p><p>SB 3 passed in a 13-8 vote, with Sen. Bruce Ennis as the only Democrat to join seven Republicans in voting against the measure.</p><p>Lawmakers also approved<a href="https://legis.delaware.gov/json/BillDetail/GenerateHtmlDocument?legislationId=48512&amp;legislationTypeId=1&amp;docTypeId=2&amp;legislationName=SB6"> Senate Bill 6</a>, which makes magazines that hold more than 17 rounds illegal. Again, Ennis was the lone Democrat to vote no.</p><p>“Magazines capable of feeding 30, 40, 50, or 100 rounds of ammunition into weapons are a common thread among mass shooters in the United States,” said bill sponsor Sen. David Sokola. “The more bullets one can fire, the more death and injury one can cause.”</p><p>Both bills were part of a two-hour Senate Judiciary Committee hearing on Wednesday, which drew local and national groups to make their arguments for and against the measures.</p><p>Megan O’Donnell of Wilmington was attending a country music festival in Las Vegas when a gunman opened fire, killing 59 and injuring hundreds more in 2017. Now a volunteer leader with the group Moms Demand Action, O’Donnell said a ban on high-capacity magazines could have reduced the massive number of victims at that Nevada concert.</p><p>“How many people would still be here today?” she asked committee members. “Mass shooters aiming to inflict mass casualties are specifically seeking out these magazines because they increase the number of bullets they can fire without reloading.”</p><p>Opponents of the bill like David Mellon said the magazine size limits would benefit criminals who wouldn’t abide by the law anyway.</p></div></div><div class="flexible-content flexible-content--wysiwyg row-outside--sm"><div class="flexible-content-container wysiwyg-styles"><p>“By limiting our capacity to defend ourselves, we’re going to be outmatched by criminals. That is just unacceptable,” Mellon said.</p><p>There was similar debate over the bill requiring permits and training for handgun purchases. Some opponents said the extra cost to get trained and buy a permit would disproportionately affect residents who make less money.</p><p>Others said people who need to protect themselves would be at risk while waiting for their permits and training to be completed. Several opponents, including Phillip Shull, pointed to<a href="https://www.nbcphiladelphia.com/news/local/christie-gun-commission-carol-bowne-michael-eitel-license/62393/"> a 2015 case in New Jersey in which a woman who had applied for a gun license was stabbed</a> to death in an apparent domestic dispute.</p><p>“There are many instances of women being murdered while waiting for these permits,” Shull said. “A right delayed is a right denied, and these bills will have implications that will hurt people.”</p><p>Democratic Sen. Kyle Evans Gay challenged those who argued against the bills in that manner, saying it used women as props. “I would ask how many women have to die by gunshot wounds in the name of ‘arming women to protect themselves,’” she said.</p><p>Daniel Webster, director of the Center for Gun Policy and Research at Johns Hopkins University, also refuted those claims, saying permit laws have been proven to be an effective tool to reduce gun violence.</p><p>“What we find very consistently in our research is that laws requiring permits to purchase reduce homicides, suicides, mass shootings, shootings involving law enforcement officers,” he said. “We’ve found it’s a great deterrent to diverting guns for criminal use through straw purchases.”</p><p>The debate veered off the rails as Republican Sen. Dave Lawson likened the measures to actions taken as the Nazi party rose to power.</p></div></div><div class="flexible-content flexible-content--related-content row-outside--md"><div class="flexible-content-container"><div class="block block--related-content"><article class="content-mode content-mode--teaser"><div class="flex-grid"><div class="col-text col-flex--2"><div class="f--desc"><p>Delawareans would be automatically registered to vote after visiting the Division of Motor Vehicles under a bill approved by the State Senate Tuesday afternoon.</p></div></div></div></article></div></div></div><div class="flexible-content flexible-content--wysiwyg row-outside--sm"><div class="flexible-content-container wysiwyg-styles"><p>“Hitler was legal in what he did, and it was because of legislation and legislators that paved the way for that,” Lawson said. “To expect people to obey this and continue this overreach of government is asking to wake up a giant that you may not want.”</p><p>A similar effort to require permits and training for handgun purchases failed to get brought up for a vote when it was introduced in 2019. A large-capacity magazine ban also failed to see action after being introduced the same year.</p><p>One of the things both bills had in common is they were assigned to the Senate executive committee. That committee was chaired by then-Senate President Pro Tempore David McBride. McBride was upset in the Democratic primary in 2020 by progressive candidate Marie Pinkney. During the campaign, Pinkney said McBride “intentionally withheld the process of obtaining a Senate vote on these bills.”</p><p><a href="https://whyy.org/articles/i-was-shocked-four-newcomers-beat-democratic-incumbents-in-delaware-primary/">Pinkney’s win, along with several other newcomers in the Democratic caucus</a>, likely helped push the Senate leaders to hold votes on the floor Thursday.</p><p>“If the past two elections were a referendum on any single thing, they were a referendum on whether Delaware would pass these bills,” said Sen. Sarah McBride, another rookie in the Senate. “We each ran on a platform supporting commonsense gun reform.”</p><p>The bills also got support from state Attorney General Kathy Jennings, who spoke during Wednesday’s committee hearing.</p><p>“The status quo, a gun violence epidemic without parallel in the developed world, is simply unacceptable,” Jennings said. She called those who oppose the bills and other gun safety measures “a passionate minority of the public.”</p><p>Gov. John Carney has previously expressed support for the measures, as well.</p><p>The bills now move to the House.</p></div></div>						</div>

If there’s a natural disaster in South Carolina where the cops can’t protect my neighborhood, my house will be the last one that the gang will come to because I can defend myself.”</p><p>Graham also addressed Sen. Dianne Feinstein’s (D-CA) “assault weapons” ban, challenging Senate Majority Leader Chuck Schumer (D-NY) to bring it up for a vote.</p><p>Graham said, “I would challenge Sen. Schumer to bring the assault weapons ban to the floor of the United States Senate. It is written so as to ban 205 different firearms as well as ammunition magazines holding more than ten rounds.</p><p>On January 13, 2021, Breitbart News <a href="https://www.breitbart.com/politics/2021/01/13/434-million-firearms-manufactured-for-private-ownership-over-past-25-years/">pointed to</a> National Shooting Sports Foundation numbers showing there are 20 million firearms in private possession which Democrats label “assault weapons.” In other words, Sen. (AP)- A Democrat-led Senate committee on Wednesday released two bills outlawing high-capacity magazines and requiring anyone wanting to buy a handgun to first obtain a permit from the state.</div></div></div><div><div class="Article-paragraph"> </div></div><div><div class="Article-paragraph"><div>The move came despite concerns by critics that the bills are unconstitutional, racially discriminatory and will not reduce gun violence by criminals.</div></div></div><div><div class="Article-paragraph"> </div></div><div><div class="Article-paragraph"><div>After two hours of public comment in a virtual meeting attended by nearly 700 people, Judiciary Committee Darius Brown, D-Wilmington, declined to call for a public vote by committee members. The bills instead were released after being circulated privately among committee members for their signatures.</div></div></div><div><div> </div><div>The permit bill is estimated to cost taxpayers about $4 million next year to implement and about $3.6 million annually after that. After the Judiciary Committee hearing, it was signed by members of the Democrat-led Finance Committee without public notice or hearing, clearing the way for floor votes by the full Senate on Thursday.</div></div><div><div class="Article-paragraph"> </div></div><div><div class="Article-paragraph"><div>Supporters of the proposals contend that they would help reduce violent crime, gun homicides and suicides.</div></div></div><div><div class="Article-paragraph"> </div></div><div><div class="Article-paragraph"><div>“It will keep handguns out of criminal hands, and that will save lives,” Majority Whip Elizabeth Lockman, D-Wilmington, said of her permit bill, adding that similar measures in other states have been associated with a decline in gun deaths.</div></div></div><div><div class="Article-paragraph"> </div></div><div><div class="Article-paragraph"><div>Senate President Pro Tem David Sokola, D-Newark, said his bill limiting magazine capacity to 17 rounds is less restrictive than laws in other states. He cited a 2017 ruling by a divided federal appeals court that upheld a Maryland law limiting magazine capacity to 10 rounds.</div></div></div><div><div class="Article-paragraph"> </div></div><div><div class="Article-paragraph"><div>“This bill does not come close to that number,” Sokola said. “Instead, it sets a reasonable limit that will eliminate the kind of magazines commonly used in mass shootings, gun crimes and police shootings.”</div></div></div><div><div class="Article-paragraph"> </div></div><div><div class="Article-paragraph"><div>The bill gives existing owners of such magazines until June 30, 2022, to surrender them to the state.</div></div></div><div><div class="Article-paragraph"> </div></div><div><div class="Article-paragraph"><div>Opponents argued that criminals will ignore the bills, just as they ignore existing gun laws. One critic pointed to a 2019 report by the U.S. Department of Justice following a survey of prison inmates regarding the source and use of guns involved in crimes. The survey found that slightly more than 1% of all state and federal prisoners used a firearm during the offense for which they were imprisoned that had been obtained from a retail source. Among prisoners who possessed guns during their crimes, 90% did not obtain them from a retail source.</div></div></div><div><div class="Article-paragraph"> </div></div><div><div class="Article-paragraph"><div>Opponents also said the permit requirement discriminates against low-income people and members of minority communities who may not be able to afford the costs of training and fingerprinting, on top of the price of a gun itself.</div></div></div><div><div class="Article-paragraph"> </div></div><div><div class="Article-paragraph"><div>Critics also said the permit bill imposes conditions on the right to gun ownership enshrined in the federal and state constitutions. Exemptions for members of the military and for active and retired police officers also raise questions of equal protection under the law, they contend.</div></div></div><div><div class="Article-paragraph"> </div></div><div><div class="Article-paragraph"><div>“It’s wrong to license a liberty,” said Jay Lowman.</div></div></div><div><div class="Article-paragraph"> </div></div><div><div class="Article-paragraph"><div>Allison Anderman, senior counsel for the Giffords Law Center to Prevent Gun Violence, said courts have upheld similar restrictions in other states.</div></div></div><div><div class="Article-paragraph"> </div></div><div><div class="Article-paragraph"><div>“The opposition is rooted in gun rights extremism, not facts, and not a desire to save lives in Delaware,” she said.</div></div></div><div><div class="Article-paragraph"> </div></div><div><div class="Article-paragraph"><div>Democratic Attorney General Kathleen Jennings similarly dismissed critics of the permit bill as “a passionate minority.”</div></div></div><div><div class="Article-paragraph"> </div></div><div><div class="Article-paragraph"><div>Opponents, meanwhile, suggested that gun-control advocates are naive to think that the measures will reduce gun crimes.</div></div></div><div><div class="Article-paragraph"> </div></div><div><div class="Article-paragraph"><div>“Seventy percent of criminals who commit gun crimes are already prohibited in Delaware,” said Kim Petters of Magnolia.”&#8230; Let’s start focusing on criminals, and not law-abiding citizens.”</div></div></div><div><div class="Article-paragraph"> </div></div><div><div class="Article-paragraph"><div>The permit bill requires a person wanting to buy a handgun to complete an approved training course, then submit a permit application to the state. State officials would have 30 days to fingerprint applicants, confirm that they are legally permitted to own a handgun, and issue a “qualified purchaser card” that would be valid for 180 days. Anyone denied a card would have 30 days to request a court hearing.</div></div></div><div><div class="Article-paragraph"> </div></div><div><div class="Article-paragraph"><div>The bill allows state officials to deny a card to any person “who poses a danger of causing physical injury to self or others by owning, purchasing, or possessing firearms.” It does not explain how that determination would be made, or who would make it.</div></div></div><div><div class="Article-paragraph"> </div></div><div><div class="Article-paragraph"><div>State officials would be required to keep demographic data on permit applicants, including race, ethnicity, national origin, sex, gender, age, disability, and English language proficiency. They also would maintain a database that would be open for inspection by any judge, justice of the peace, or law enforcement officer. Lockman added an amendment to her bill on Wednesday prohibiting officials from keeping records for longer than two years, “except in furtherance of an open criminal investigation or during the course of a criminal prosecution.”</div></div></div></div>						</div>
